EB-5 Investor Visa 

VM Gokea Law Group works closely with the investor, tax advisors and business consultants to prepare the EB-5 petitions with all required documentation. We prepare and file the permanent residency application, we follow up in removing the condition and we assist the investor and his family in obtaining their permanent green card.

The EB-5 investor may invest $1 million (or $500,000 in a high unemployment or rural area) in his own new company that will create 10 full-time jobs for US workers, or may invest in an existing company that needs funds to keep functioning and keep its employees.

The EB-5 Investor Program is extremely beneficial for the wealthy investor who can afford to invest in an American enterprise. This is a preference category with a very short waiting period and much faster adjudication than most other immigrant visas.

The reason EB-5 has a preferential priority is that US Congress wants the creation of jobs for theUS workers and encourages the flow of foreign investment in US companies.

The investor, the spouse, and their children 21 years old or younger could obtain their permanent US residency with investments such as:

  • $1 million in any U.S. commercial enterprise that will create 10 full-time jobs for US workers
  • $500,000 in targeted rural / high unemployment areas that will create 10 full-time jobs for US workers
  • $500,000 in a government approved Regional Center

Also, there are the government pre-approved Regional Centers where the investor may participate as a limited partner with an investment of $500,000 and obtain the permanent residency based on the creation of direct or indirect jobs. In this case the investment of $500,000 is placed in an escrow account and is released to the Regional Center ONLY after the conditional permanent residency has been approved by US Citizenship and Immigration Services.

Critical:

  • The most critical requirement for the EB-5 investor is the ability to document the lawful source of the funds invested
  • The most critical requirement from the company where the funds are invested is to provide documentation that 10 full-time jobs have been created or will be created directly or indirectly by the investment of each EB-5 investor.
